Arbitrator for the 11th Hanover PreMoot

The Willem C. Vis Moot in Vienna is judged by close to 500 attorneys, research assistants and professors from all around the world every year. Furthermore a sister competition is held in Hongkong.

The Willem C. Vis Moot is intended to stimulate the study of international commercial law, the legal texts prepared by the United Nations Commission on International Trade Law, and the use of international commercial arbitration to resolve international commercial disputes. The international nature of the Moots are intended to encourage participants to interpret the texts of international commercial law in the light of different legal systems, and to develop an expertise in advocating a position before an arbitral panel composed of arbitrators from different legal systems. It is designed to be an educational program with many facets in the form of a competition.

The Annual Hannover PreMoot is designed to mimic the actual Willem C. Vis Arbitration Moot in Hongkong and Vienna. As such, the rules are identical to those of the actual Willem C. Vis Moot.

Guidelines for Arbitrators (Introduction)

Chairman (or Presiding Arbitrator)

The presiding arbitrator of a panel should feel free to control the proceedings in the argument as he or she might in a real arbitration. The organizers of the Willem C. Vis Moot do not consider it a disadvantage if different panels conduct the proceedings in different ways, so long as basic considerations of fairness to the two teams are observed.

Normally the first person listed in the panel would serve as the presiding arbitrator. However, if that person does not wish to serve in that capacity or for other reasons a different presiding arbitrator is appropriate, each panel is free to choose its own presiding arbitrator.

Length of argument

The oral presentation of each team is, in principle, thirty (30) minutes.

The team should allocate equitably the time available to the two individual advocates. However, the arbitral tribunal may exceed the time limits stated so long as neither team is allowed more than forty-five (45) minutes to present its argument, including the time necessary to answer the questions of the tribunal.

It will be the responsibility of the tribunal to ensure that the teams are treated fairly.

 

Questions from arbitrators

The arbitrators are requested to act during the oral hearings as much as possible the way they would in a real arbitration.

There are significant differences in style dependent both on individual personalities and on perceptions of the role of an arbitrator in oral argument. Some arbitrators, or arbitral tribunals, may interrupt a presentation with persistent or even aggressive questioning. Other arbitrators, or arbitral tribunals, may listen to an entire argument without asking any questions.

Because this is a PreMoot serving for preparation purposes, arbitrators are encouraged to ask questions.

 

Scoring & Evaluation by the Arbitrators

Before scoring each team, after an argument the arbitrators are encouraged to give the students oral evaluations of their performance. Students appreciate knowing what they did well and in what respects they should improve.

Arbitrators have a total of 30 minutes to provide feedback to both teams. The arbitrators should divide this time equally among the two teams. Feedback should be given on both the substance and presentation of the competitors’ arguments. Please remember that the PreMoot is intended to be an educational experience for the competitors. We also ask that arbitrators take the time to jot down some comments on the comment sheets for the competitors to review after the PreMoot.
